RELEASE OF LIABILITY, ASSUMPTION OF THE RISK AND INDEMITY AGREEMENT

PLEASE READ THIS CAREFULLY, THIS IS A LEGALLY BINDING AGREEMENT THAT IS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS

I,____________________________________, have chosen to enter the VaultingPro LLC facility in Indiana, and use the Premises, equipment, facilities, services and of horses of boarders of the named facility or Ariane Panahi. I hereby acknowledge and agree that (1) stimulus, (2) horseback riding is a dangerous activity, regardless of my experience, skill level or the or the care with which a horse is selected for me to ride, and (3) there are many obvious and non-obvious risks or danger associated with activities around or concerning horses and other equine despite all safety precautions taken. I recognize that the risks of harm from using the Premises, equipment, facilities, services, otherwise being injured as a result of faulty gear, saddlery, tack or other equipment, being injured by animals, reptiles or insect located or around the Premises, being injured by any natural or unnatural, obvious or hidden hazards located on or around the Premises, including, without limitation, cliffs, rocks, holes, fences, machinery, stumps logs ditches, debris, roads, washes, lakes, streams, rivers, trails rugged, terrain cacti or other flora being injured by the forces of nature, and being injured by any negligent acts or omissions of any person, enumerated risks. I also acknowledge that there may be other risks not known to me or that are not reasonably foreseeable at this time. I HEREBY EXPRESSLY AGREE TO ASSUME ALL OF THE ABOVE RISKS AND OTHER RELATED RISKS, KNOWN OR UNKNOWN, WHICH MAY BE ENCOUNTERED BY MY USE OF THE PREMISES, EQUIPMENT, FACILITIES, SERVICES, AND/OR HORSES OF THE RANCH OR BY MY PARTICIPATION IN ANY ACTIVITY ON OR AROUND THE PREMISES.

Furthermore in consideration of being permitted to use the Premises, equipment, facilities, services, horses and or other equine of the VaultingPro LLC as well as Ariane Panahi, I HEREBY RELEASE, WAIVE, DISCHARGE AND PROMISE NOT TO SUE THE VAULTINGPRO LLC, ITS OWNERS, SHAREHOLDERS, OFFICERS, AGENTS OR EMPLOYEES, AND EACH OF THEM, FROM ALL LIABILITIES, CLAIMS, DEMANDS, RESPONSIBILITIES, CAUSES OF ACTIONS, OR EXPENSES (INCLUDING, WITHOUT LIMITATION, JUDGMENTS, ATTORNEYS FEE AND COURT COSTS) ARISING OUT OF OR RELATED TO ANY ACTIVITY ON THE PREMISES, HORSE SELECTION AND TRAINING. INSTRUCTION OR SUPERVISION OF RIDERS, OR MY USE OF THE PREMISES EQUIPMENT, FACILITIES SERVICES, HORSES, AND OR OTHER EQUINE OF THE RANCH, OF THE RANCH, INCLUDING, WITHOUT LIMITATION AND INJURY, DEATH OR DAMAGE ARISING OUT OF THE NEGLIGENCE OF THE ABOVE NAMED PARTIES OR OTHERVISE. Nonetheless, this Agreement does not cover and injury, death or damage arising out of any gross negligence or reckless or intentional misconduct.

In further consideration of being permitted to use the Premises, equipment, facilities services, horses and or other equine of the Ranch, I HEREBY AGREE TO INDEMNIFY, PAY PROTECT, DEFEND AND HOLD HARMLESS, THE RANCH, ITS owners, officers, agents or employees, volunteers, and each of THEM FROM ALL LOSSES, LIABILITIES DAMAGES OR COSTS that I may incur arising out of or related to any activities on or around the Premises WHETER CAUSED BY THE NEGLIGENCE OF the Stable, its owners, officers, agents, volunteers or employees or otherwise.

I expressly agree that this Agreement is binding on my estate, heirs, administrators, next of kin and assignees, I agree that this Agreement is the entire agreement between me and the Ranch with respect to the subject matter set forth herein and that any modifications or changes to this Agreement must be in writing and signed by me and a representative of the Ranch. I also acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the state of Indiana. I agree that if any portion of this Agreement is determined to be invalid or unenforceable, that part will be amended to achieve, as nearly as possible, the same effect as the original and the balance of the agreement shall remain in full force and effect. This Agreement is execute in the court of Indiana.

I represent and covenant to the Ranch that I have sufficient personal health, accident and liability, insurance to cover injuries or property damage that I could sustain or cause while engaging in activities on or around the Premises. I certify that my child or any other children in my custody have a eligible health insurance that will cover any horse related accidents or other injuries. I also certify to VaultingPro LLC that, other than as set forth in the space below or on documents attached hereto, I have no physical or mental conditions, and that I am taking no medication which will adversely affect my ability to engage in activities on or around the Premises:

I HAVE READ THIS RELEASE OF LIABILITY, ASSUMPTION OF THE RISK AND INDEMINITY AGREEMENT AND I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENTS, ASSURANCE OR GUARANTEE BEING MADE TO ME.
