Horse Training and Boarding Agreement

(2) The Owner ____will, or ___will not (check one) shoe the horse prior to training. (3) The Owner ____will, or ___will not (check one) provide all needed health shots for the current year.

(4) Lessons
The Trainer ___will, or ___ will not (check one) provide lessons. ___times/month. Lessons must be taken in the month in which they were scheduled. If the Trainer is unable to attend any lesson, there can be arranged at other times, but not a must.
(5) The Owner of ____________ agrees to hold harmless, defend and indemnify the trainer against any claims or action for damage or injury resulting from the use of any horses and equipment which are subject of this agreement while such horse(s) and equipment are in the possession and under control of the Lessee. The Lesser agrees to notify the Lessee in the defense of any such claims and actions. Lessee agrees to adhere to the provisions of Indiana Statue _________ regarding liability risk inherent in equine activities._____
Warning AN EQUINE PROFFESSIONAL IS NOT LIABLE FOR ANY INJURY TO OR THE DEATH OF A PARTICIPANT ENGAGED IN AN EQUINE ACTIVITY RESULTING FROM THE RISKS INHERENT IN EQUINE ACTIVIETIES. MS.
(6) The owner agrees to keep the horse(s) for a period of ______ months at the following facility,_______________ which is agreed upon at the signing of this contract.
The horse can only be taken out of the facility with owners knowledge and consent.
(7) Payment
The Owner of ________ shall pay the Trainer a fee in amount of $________, payable as follows 1st of every month. Fee will be added if not paid by the 5th of every month. The amount of ______ not refundable.
A deposit of $350.00 is required which may be used in case of emergency related to horse or for the last months of boarding.
8) Care of the horse
The Trainer agrees to take full responsibility for the care of the horse. It is understood that the Trainer will follow practices of good animal husbandry in protecting this animal from illness, injury or suffering. This will include all necessary attention but not limited to: cleaning and picking the hoofs before mounting, proper warm up in walk, cool down after work out-showering in summer, no food one hour before or after ride (only hay).
Owner shall not hold Trainer liable for any serious injury or death of the horse arising from events not resulting from negligence on the part of the Trainer. Trainer shall hold the Owner harmless for any injury to persons or damages to any property cause by the trained horse.
9) Care of Tack
The Owner provides all tack for the horse. The Trainer agrees to take care of the tack.
10) Training
The Trainer will go with the trainings plan as much as possible. If the trainings plan can not be followed for a longer period of time the Owner has to be informed.
11) Shows
The Trainer agrees to provide transportation to and from shows on Owners full expense.
12) Illness
If the horse is sick the owner needs to be informed as soon as possible.
13) Boarding
The horse is boarded for ______ months for the amount $___________ per months that includes daily turnouts (weather permitting), feeding twice a day. Hay _____ flakes. The necessary care of the horse like cleaning the stalls, watering are included.
14) Emergency Care
Trainer attempts to contact the owner at the following emergency telephone number _______________ should the trainer feels the medical treatment is needed, provided however that in the event that the trainer is unable to contact the owner within the reasonable time which time shall be judged and determined solely by the trainer, trainer is then hereby authorized to secure emergency veterinary care and/or blacksmith care and by any licensed providers of such care who are selected by the trainer as trainer determines is required for health and well being of the said horse. The cost of such care secured shall be due and payable by the owner within 15 days of the date owner receives notice thereof, provided however, that trainer is authorized to arrange direct billing by said care provider to the owner.
15) Notice of Termination
The owner agrees that 30 days notice shall be given to the trainer as to terminate this agreement. This notice must be given at the beginning of a month.
16) Right of Lien
Owner is put on notice that trainer has and may assert any exercise right of lien, as provided for by the laws of state of Indiana, for any amount due for the board and keep of the horse, and also any storage or other charges due hereunder, and further agrees trainer shall have the right without process of law, to attach a lien to the horse after two months of non-payment or partial payment and trainer can sell the horse to recover his/her loss.
17) Stable Rules
Owner hereby acknowledge and understand the current stable rules, which are incorporated by reference in full, as if fully said forth herein. Owner agrees he/she and their guests invitees will be bound and will abide with these rules, and accept responsibility for the conduct of his guests and invitees according to these rules. Owner acknowledges these rules but not limited to:
Stable Hours of Operation Stable Safety Rules Notice of requirement release and waiver for minors and adults Statement of applicable state equine liability laws Required veterinary care
Stable may revise the rules from time to time and owner agrees any revision shall have the same force and effect as current rules. Failure, as determined in Stable’s sole discretion, of owner or owner’s guests and invitees to abide by Stable rules may result in Stable declaring owner in default hereunder and result in termination of this agreement.
18) Default
Either party may terminate this agreement for failer of the other party to meet any material terms of this agreement, including but not limited to Stable Rules section of this agreement. In the case of a default by one party, the other party shall have the right to recover legal fees and expenses, if any, incurred as a result of said default. Any payment due Stable under this agreement shall be due and payable by the tenth day of the month and immediately in the event of termination. Failure to make any payment by said due date shall place owner in default hereunder. Acceptance by Stable of any late payment shall not constitute a waiver of subsequent due dates or determination of default.
This agreement is subject o the laws of the State of Indiana. |
